Celebrity Court Watch - Lindsay Lohan is suing e-Trade over a "milkaholic" TV commercial spot. Lohan is suing the Manhattan-based financial firm for defamation because she believes a "milkaholic" baby featured in one of its commercials - who is named Lindsay - is based on her.
She has suffered her first setback in her quest for the one hundred million dollar prize she seeks, she filed the lawsuit in Nassau County Supreme Court, but the case will be moved to the city.
Lohan's argument before the court is that was where she lived and that is why the suit should be filed there.
However, Manhattan Supreme Court Justice James Yates has granted E-Trade's request to have the case moved to the city, where its headquarters are located.
"Plaintiff's affidavit does not reveal anything about how the plaintiff divides the time between her residences or how long she spends at each residence, and thus this lack of proof is insufficient to show residence in Nassau County," Yates wrote.
